Terms and Conditions (T&Cs)
These Terms and Conditions (T&Cs) apply to all contracts, deliveries, and services of KWC Group AG – hereinafter referred to as “KWC” or “we” – regardless of whether the order is placed via the online shop (or another e-commerce platform), by phone, by e-mail, in writing, in person, or by any other means.
By placing or confirming an order, both the Customer and KWC commit to complying with and accepting the following Terms and Conditions in full.
Only the following Terms and Conditions, in the version valid at the time of ordering, shall apply.
Any Terms and Conditions of the Customer apply only insofar as KWC expressly agrees to them in writing.
1. General applicability
Unless expressly agreed otherwise in writing, KWC delivers based on the following general terms and conditions of sale and delivery.
2. Purchase order and order confirmation
All of our offers are subject to change and are to be understood merely as an invitation to make an offer. The contract with the Customer shall only come into effect upon receipt of our written order confirmation. All information on our website or in our catalogs and brochures, such as product descriptions, illustrations, weights, and dimensions, is non-binding. KWC expressly reserves the right to make changes in this regard. Verbal and telephone agreements only become binding through our written confirmation. The confirmed purchase order is irrevocable for the Customer and cannot be contested on the grounds of error (Art. 23 et seq. CO). The Customer can only revoke custom-made products that are already in production if the Customer assumes the costs incurred up to the point of revocation.
3. Prices
All prices listed in our price lists are trade prices per unit, exclusive of VAT and shown in the currency specified. Not included are, in particular, any small-quantity surcharges as well as packaging, express, and shipping costs. Prices are subject to change without notice; in the event of a significant change in circumstances even after the conclusion of the contract, provided that this was neither foreseeable at the time of the conclusion of the contract nor caused by KWC.
4. Payments
The minimum order value (invoice value) per order is CHF 25 (after discount deduction). The payment period is 30 days net from the date of invoice. Once the payment term has lapsed, the respective invoice amount is due for payment immediately, and the Customer is in default without further reminders from KWC. The Customer is not entitled to withhold payments or offset them against counterclaims, even in the event of complaints or counterclaims. Any unauthorized discounts will be automatically charged retrospectively.
5. Packaging, dispatch, and shipping costs
Our products are carefully packaged according to industry practice. Additional packaging costs may apply in case of special packaging.
Unless agreed otherwise in writing, deliveries shall be made according to the Incoterms® in their currently valid version. If no Incoterms® have been agreed upon, the Customer shall bear the transport costs. The risk is transferred to the Customer as soon as the goods leave the KWC warehouse or are made available to the Customer in the KWC warehouse. Obvious transport damage must be reported directly to the carrier.
For international shipments, the country-specific and/or individually agreed shipping and delivery conditions apply. The above-mentioned arrangements shall also apply, provided that they do not contradict the country-specific and/or individually agreed shipping and delivery conditions.
Further information regarding shipping within Switzerland:
For orders placed through the online shop, shipping/freight costs will be charged for invoice amounts under CHF 50. The applicable shipping costs will be displayed during the order process.
For all other orders, shipping/freight costs will be applied to invoice amounts under CHF 100 (after discount deduction). Delivery is free of charge for orders over CHF 50 (online shop) or CHF 100 (other orders).
6. Delivery, partial deliveries, and delivery deadlines
The agreed delivery dates and delivery deadlines will be adhered to as far as possible but are only considered approximate and are therefore non-binding.
KWC is entitled to partial deliveries as far as they are reasonable for the Customer. Each partial delivery is considered an independent transaction and can be invoiced separately.
If it becomes apparent after the conclusion of the contract that the ordered goods cannot be delivered or cannot be delivered in full (such as due to proven delivery bottlenecks or delivery delays), KWC is entitled to withdraw from the contract or from a portion of the contract. If the Customer’s payment has already been received by KWC, it will be refunded proportionally for undelivered goods. If no payment has been made, the Customer will be released from the obligation to pay. In the event of termination of the contract, KWC is not obliged to provide a replacement delivery.
A delay in delivery or a partial delivery entitles the Customer neither to claim damages, nor to cancel the entire order, nor to assert penalties for delays.
Further claims of the Customer, in particular claims for damages due to delay or non-performance, are excluded to the extent permitted by law.
7. Warranty
We warrant that our products will function properly, provided that they have been installed correctly and in accordance with the intended purpose of the product. For materials not produced by us, we provide a warranty within the scope of our subcontractors’ terms and conditions.
In the case of improper assembly or incorrect assembly, treatment, cleaning, excessive use, natural wear and tear, or failure to observe the instructions for care, any warranty is excluded.
The warranty also applies exclusively to products that have been distributed through authorized distribution channels in the respective sales region. For re-imported goods, only the sales provisions of the original sales region apply.

The shapes and dimensions specified in our catalogs and brochures are for illustrative purposes and are subject to change at any time.
Our color variations are partly based on differences in materials. Colors can vary depending on material quality, manufacturing process, and the particular surface. Such deviations are due to the process and do not constitute a quality defect. Minor color deviations between individual products or deliveries are due to technical reasons and are unavoidable.
When manufacturing according to Customer specifications, the Customer is fully responsible for ensuring that neither intellectual property rights nor other rights of third parties are violated.
In the case of proven warranty claim, KWC has the right to decide on the type of warranty. At KWC’s sole discretion, it can:
- Eliminate the defect through rectification (product repair)
- Deliver an equivalent substitute (product replacement)
- Or appropriately reduce the purchase price (price reduction)
Repair services require prior consultation with KWC. Shipping costs must be borne by the Customer.
Unless provided for in these T&Cs, the assertion of further claims or remedies (damages, in particular) is expressly excluded.
Notice of defects:
The buyer shall, as soon as it is feasible in the normal course of business, examine the quality of the received product and, if defects are found for which KWC is liable under these T&Cs, notify KWC within the statutory period.
All warranty claims against KWC shall in any case expire after two years from the delivery of the product to the first customer (regardless of whether it is a B2B or a B2C consumer).
Notice of extended warranty on KWC fittings, concealed units, and stainless steel countertop basins (“warranty products”) from January 1, 2026:
KWC shall grant a five-year voluntary warranty against material and manufacturing defects for all warranty products purchased on or after January 1, 2026. The warranty period begins on the date of purchase as stated on the proof of purchase.
The warranty is valid in any case for a maximum of six years after the date of manufacture.
The warranty period does not restart when a product or a component is replaced or repaired free of charge as part of the warranty. If the replacement or repair is carried out in whole or in part for a fee, the warranty period for the replaced product or component will start anew from the new purchase date as stated on the proof of purchase.
Accessories, tools, wear and tear parts, replacement parts, electronic components, and consumables are excluded from the voluntary warranty.
The warranty applies exclusively to warranty products that are sold and installed in Switzerland through authorized distribution channels to Customers domiciled in Switzerland. For Customers who are not domiciled in Switzerland, the warranty provisions of these T&Cs do not apply, even if KWC Group AG, Switzerland, serves these Customers. In addition, re-imported products are subject exclusively to the sales provisions of the original sales region.
The details and conditions of this extended warranty will be published in a timely manner on our website and in the respective product documentation before entry into force.
Unless these T&Cs expressly provide otherwise, all other warranty provisions in Section 7 shall also apply to products covered by the extended warranty period.
8. Product liability
KWC assumes no liability towards the Customer that goes beyond the warranty described above. The Customer undertakes to exclude, within the scope of legal possibilities and with validity also for KWC, product liability claims and other contractual and non-contractual claims asserted by their buyer. The Customer must promptly notify KWC of any claims that a buyer makes or could make based on product liability. The Customer is prohibited from acknowledging any liability under product liability law without prior consultation with KWC.
9. Exclusion of liability
Regardless of the legal grounds (contractual, non-contractual, or for auxiliary persons), KWC is liable only for gross negligence or unlawful intent, or in cases of product liability. Any further liability is excluded.
10. Special Terms and Conditions for E-Commerce (Online Shop)
10.1 Scope of Application
The following provisions apply additionally to contracts that are concluded remotely, in particular via our online shop, between KWC Group AG and consumers (B2C).
10.2 Conclusion of contract in the online shop
The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to issue a purchase order. With the completion of the order process, the Customer submits a binding offer. The contract is concluded when we accept the purchase order by sending an order confirmation by e-mail or by delivering the goods.
10.3 Prices and payment
All prices stated in the online shop are inclusive of statutory VAT and exclusive of shipping costs, unless stated otherwise. The available payment methods are displayed during the order process.
10.4 Delivery and transfer of risk
The delivery will be made to the address specified by the Customer. For consumers, the risk of accidental loss and accidental deterioration of the goods sold passes to the Customer upon delivery of the goods to the Customer.
10.5 Right of withdrawal for consumers
Consumers generally have a right of withdrawal of 14 days. The withdrawal period is 14 days from the day on which the goods have been received by the Customer or a third party designated by the Customer as soon as the Customer or a designated third party receives the goods.
Exclusion of the right of withdrawal – The right of withdrawal does not exist in the case of:
- Goods that are not prefabricated and for the production of which an individual selection or specification by the Customer is decisive or that are clearly tailored to the personal needs of the Customer (custom-made products)
- Services, provided that they have been rendered in full or have begun with the express consent of the Customer before the expiry of the withdrawal period
- Goods that are not suitable for return for reasons of health or hygiene, and whose seal has been removed after delivery
- Goods that can no longer be sold as new after the packaging/label has been opened
10.6 Exercise of the right of withdrawal
To exercise the right of withdrawal, the Customer must inform us of their decision to withdraw from this contract by means of a clear declaration (such as by letter or e-mail). To comply with the deadline, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the deadline expires.
In the event of a cancellation, all payments will be refunded immediately and no later than 14 days after we receive the goods. Repayment is made using the same payment method that the Customer used for the original transaction, unless other arrangements are agreed. The costs associated with returning the goods are borne by the Customer.
10.7 Warranty and liability in e-commerce
The warranty and liability provisions in sections 7 and 9 of these T&Cs apply to consumers.
10.8 Contract text & data protection
We do not store the text of the contract. The current T&Cs can be viewed at any time on our website.
10.9 Visibility and availability of certain products
Certain products or special offers are exclusively available through the online shop and are only displayed to registered and logged-in users. There is no entitlement to viewing or purchasing these products outside of the online shop or without the appropriate login.
10.10 Color representation in the online shop
The colors and surfaces displayed on the website or in the online shop may differ from the actual product colors for technical reasons (such as screen display, lighting conditions, and monitor settings). Such color deviations do not constitute a defect and do not justify a complaint.
11. Data protection
KWC collects, processes, and uses personal data of Customers only within the framework of legal provisions and to the extent necessary for the performance of the contract, delivery, invoicing, and customer service, as well as to fulfill legal obligations.
If the Customer subscribes to a newsletter, their data will also be used for sending information about products and offers from KWC. The Customer can unsubscribe from the newsletter at any time using the unsubscribe link contained in each newsletter or by notifying KWC.

12. Contract language
The contract language is German. Other language versions (if displayed) are for information purposes only.
If individual provisions of these T&Cs are or become invalid, either in whole or in part, the validity of the remaining provisions shall not be affected.
13. Applicable law and place of jurisdiction
The substantive law of Switzerland shall apply. The applicability of conflict-of-law provisions and of international conventions (in particular the UN Convention on Contracts for the International Sale of Goods) is expressly excluded.
The exclusive place of jurisdiction is Unterkulm, Switzerland. Mandatory provisions governing consumer jurisdictions shall remain unaffected.
